He is 50-year-old Horace Clarke, of McVickers Lane, Spanish Town, St Catherine.

On Tuesday, attorney Denise Hinson submitted to the court that a non-custodial sentence would be appropriate for Clarke, as her client attended his mother’s funeral and returned to the police.

Parish Court Judge Janelle Nelson-Gayle told the defence that she would be going against the sentencing guidelines if Clarke was not incarcerated.

The judge advised that the maximum is two years’ imprisonment, but given his age and the lawyer’s submission, Clarke would benefit from a reduction.
